By requesting this video, I (“Requester”) agree to the following terms:
  1. I will hold and maintain the video disclosed to me by the Airports Authority in the strictest confidence and for the sole purpose of investigating an alleged incident. I will not make any copies, extracts or other reproductions, in whole or in part without prior written approval from MWAA. I will not allow anyone else to view the video without MWAA’s express written approval.  If I wish to have anyone else to view the video I am authorized to introduce this video as evidence at a trial, provided that the video may not be filed in the court records except under seal and may not be disclosed to opposing counsel except pursuant to a protective agreement, copy of which shall be provided to MWAA for approval prior to its execution.  In the event that the video will be introduced in court, I agree to provide MWAA with five (5) days’ notice of the expected trial date.
  2. I will exercise no less than reasonable care in keeping the video confidential.  I shall not be liable for inadvertent disclosure of the video, provided that I use reasonable care in keeping the video confidential.  Upon discovery of any such inadvertent disclosure of the video, I will promptly advise MWAA in writing of the inadvertent disclosure.
  3. The obligations under this Agreement will not apply in the event that I am required to disclose the video pursuant to judicial order, a requirement of a governmental agency or by operation of law; provided, however, that I must provide MWAA with timely notice of such order or requirement so that MWAA may seek a protective order or other appropriate remedy.  I will, and will cause my representatives to, cooperate with MWAA to obtain any such protective order or other appropriate remedy or to narrow the scope of such request or legal process.
  4. I will return the video no later than six (6) months from the date MWAA issued the video and will not retain any copies, extracts or other reproductions, in whole or in part.
  5. This Agreement shall be in effect for all such time that the video is in my possession.
  6. This Agreement will be governed by and construed in accordance with the laws of the Commonwealth of Virginia without regard to its conflict-of-laws rules.  Any suit, action, or proceeding with respect to this Agreement will be brought in the Commonwealth of Virginia and I submit to the exclusive jurisdiction of such court for those specified purposes.
The Airports Authority's Freedom of Information Policy is not governed by federal or Virginia Freedom of Information laws.
